ACCEPTANCE OF SITE USAGE TERMS & CONDITIONS

In order to conduct business on Boekme.com one has to register. Boekme Adventures registered in Paramaribo, Suriname (“Boekme.com”, “Boekme”, “we” or “us” or “our”) owns and operates the website, www.Boekme.com  and any subdomains of Boekme.com (collectively, the “Site“). By using the Site and Boekme’s services through the Site, you agree to these Site Usage Terms & Conditions as defined below, and any additional terms applicable to certain programs in which you may elect to participate. You also agree to our Privacy Statement, located at  www.Boekme.com/privacy-statement, and acknowledge that you will periodically visit the Site Usage Terms & Conditions to familiarize yourself with any revisions. We reserve the right at all times to discontinue or modify any part of these Site Usage Terms & Conditions in our sole discretion. If we make changes that affect your use of the Site or our services we will post notice of the change on the Site. If you have an account on the Site, any changes to these Site Usage Terms & Conditions will be effective upon our notice of the changes on the Site; provided that these changes will not apply to offerings purchased prior to the effective date of such changes.  If you do not agree to the changes, you may close your account without penalty and you should not use the Site or any services offered through the Site after the effective date of the changes. If you do not have an account, any changes will be effective immediately for new and existing users of the Site and for all Products purchased after the effective date of the change. We suggest that you revisit our Site Usage Terms & Conditions regularly to ensure that you stay informed of any changes. Your use of the Site after we update these Site Usage Terms & Conditions will constitute acceptance of the modified Site Usage Terms.

The Privacy Statement, together with the Site Usage Terms & Conditions, and any other terms contained herein or incorporated herein by reference, are collectively referred to as the “ Site Usage Terms & Conditions.” The term “using” also includes any person or entity that accesses or uses the Site with crawlers, robots, data mining or extraction tools or any other functionality.

IF YOU DO NOT AGREE TO THESE SITE USAGE TERMS & CONDITIONS , IMMEDIATELY STOP USING THE SITE AND DO NOT USE ANY BOEKME SERVICE, PARTICIPATE IN ANY PROGRAM OR PURCHASE ANY VOUCHER, PRODUCT OR OTHER GOOD OR SERVICE OFFERED THROUGH THE SITE, AS YOU WILL BE BOUND BY THEM.

1: Site

The Site is a platform through which registered merchants (“Merchants”) sell services (“Vouchers).  The Merchant is solely responsible to you for the care and quality of the goods and services it provides. In addition, the Site also provides a platform through which you can purchase products from Boekme (“Products”) and participate in other available programs. All Merchant Offerings, Products, other available programs and pricing on the Site may change at any time at the sole discretion of Boekme and the Merchant, without notice. The Site, any content on the Site and the infrastructure used to provide the Site are proprietary to us, our affiliates, Merchants and other content providers. By using the Site and accepting these Terms of Use: (1) we grants you a limited, personal, non-transferable, non-exclusive, revocable license to use the Site pursuant to these Site Usage Terms & Conditions and to any additional terms and policies set forth by us; and (2) you agree not to reproduce, distribute, create derivative works from, publicly display, publicly perform, license, sell or re-sell any content, software, products or services obtained from or through the Site without the express permission of Boekme.

2: Site Usage

Unless otherwise specified, the Site and our services are intended for your personal, non-commercial use only. As a condition of your use of the Site, you agree that:

  •         You are at least 18 years of age;
  •         You are able to create a binding legal obligation;
  •         You are not barred from receiving products or services under applicable law;
  •         You will not attempt to use the Site with crawlers, robots, data mining or extraction tools or any other functionality;
  •         Your use of the Site will at all times comply with these Site Usage Terms;
  •         You will only make legitimate purchases that comply with the letter and spirit of the terms of the respective offers;
  •         You will only make purchases on the Site for your own use and enjoyment or, as a gift for another person;
  •         You have the right to provide any and all information you submit to the Site, the information and all such information is accurate, true, current and complete;
  •         You will update and correct information you have submitted to the Site and ensure that it is accurate at all times       

Boekme retains the right, at our sole discretion, to deny service or use of the Site or an account to anyone at any time and for any reason. While we use reasonable efforts to keep the Site and your account accessible, the Site and/or your account may be unavailable from time to time. You understand and agree that there may be interruptions in service or events, Site access or access to your account due to circumstances both within our control (e.g., routine maintenance) and outside of our control.

You may only create and hold one account on the Site for your personal use. You are responsible for updating and correcting information you have submitted to create or maintain your account. As part of your account settings, you have the option to: (1) save, edit or delete your personal information; and (2) opt-out of persistent login. You understand and agree that we shall have no responsibility for any incident arising out of, or related to, your account settings. You must safeguard your password and supervise the use of your account. You are solely responsible for maintaining the security of your account and maintaining settings that reflect your preferences. We will assume that anyone using the Site or transacting through your account is you. You agree that you are solely responsible for any activity that occurs under your account. Your account is non-transferrable. You cannot sell, combine, or otherwise share it with any other person. Any violation of these Site Usage Terms & Conditions, including failure to maintain updated and correct information about your account, will cause your account to fall out of good standing and we may cancel your account in our sole discretion. If your account is cancelled, you may forfeit any pending, current or future promotional account credits and any other forms of unredeemed value in your account. Upon termination, the provisions of these Site Usage Terms & Conditions that are by their nature intended to survive termination (e.g., any disclaimers, all limitations of liability and all indemnities) shall survive. We also reserve the right to change or discontinue any aspect or feature of our services or the Site, including, but not limited to, requirements for use.

3: Users Conduct

All interactions on the Site must comply with these Site Usage Terms & Conditions. To the extent your conduct, in our sole discretion, restricts or inhibits any other user from using or enjoying any part of the Site, we may limit your privileges on the Site and seek other remedies.

The following activities are prohibited on the Site and constitute express violations of these Site Usage Terms & Conditions:

  •         Submitting any content to the Site that:

o    Violates applicable laws (including but not limited to intellectual property laws, laws relating to rights of privacy and rights of publicity and laws related to defamation);

o    Contains personal information, except when we expressly ask you to provide such information;

o    Contains viruses or malware;

o    Offers unauthorized downloads of any copyrighted, confidential or private information;

o    Has the effect of impersonating others;

o    Contains messages by non-spokesperson employees of Boekme purporting to speak on behalf of Boekme or provides confidential information concerning Boekme;

o    Is purposely inaccurate, commits fraud or falsifies information in connection with your Boekme account or to create multiple Boekme accounts; or

o    Is protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right.

  •         Attempting to do or actually doing any of the following:

o    Accessing data not intended for you, such as logging into a server or an account which you are not authorized to access;

o    Scanning or monitoring the Site for data gathering purposes in an effort to track sales, usage, aggregate offering information, pricing information or similar data;

o    Scanning or testing the security or configuration of the Site or to breach security or authentication measures; or

o    Interfering with service to any user in any manner, including, without limitation, by means of submitting a virus to the Site or attempting to overload, “flood,” “spam,” “mail bomb” or “crash” the Site.

  •         Using any of the following:

o    Frames, framing techniques or framing technology to enclose any content included on the Site without our express written permission;

o    Any Site content, including without limitation User Content (defined below), in any meta tags or any other “hidden text” techniques or technologies without our express written permission;

o    The Site or any of its contents to advertise or solicit, for any commercial, political or religious purpose or to compete, directly or indirectly, with Hometown Deals; or

o    The Site or any of its resources to solicit consumers, Merchants or other third-parties to become users or partners of other online or offline services directly or indirectly competitive or potentially competitive with Hometown Deals, including, without limitation, aggregating current or previously offered deals.

  •         Collecting any of the following:

o    Content from the Site, including, but not limited to, in connection with current or previously offered deals, and featuring such content to consumers in any manner that diverts traffic from the Site without our express written permission; or

o    Personal Information (defined in our Privacy Statement), User Content or content of any consumers or Merchants.

  •         Engaging in any of the following:

o    Tampering or interfering with the proper functioning of any part, page or area of the Site or any functions or services provided by Boekme;

o    Taking any action that places excessive demand on our services or imposes, or may impose, an unreasonable or disproportionately large load on our servers or other portion of our infrastructure (as determined in our sole discretion);

o    Reselling or repurposing your access to the Site or any purchases made through the Site;

o    Exceeding or attempting to exceed quantity limits when purchasing Merchant Offerings or Products, or otherwise using any Boekme account to purchase Merchant Offerings or Products for resale or for speculative, false, fraudulent or any other purpose not expressly permitted by these Site Usage Terms & Conditions and the terms of a specific offer on the Site;

o    Accessing, monitoring or copying any content from the Site using any “robot,” “spider,” “scraper” or other automated means or any manual process for any purpose without our express written permission;

o    Violating the restrictions in any robot exclusion headers on the Site or bypassing or circumventing other measures employed to prevent or limit access to the Site;

o    Aggregating any current or previously-offered deals or content or other information from the Site (whether using links or other technical means or physical records associated with purchases made through the Site) with material from other sites or on a secondary site without our express written permission;

o    Deep-linking to any portion of the Site (including, without limitation, the purchase path for any Voucher) without our express written permission;

o    Hyperlinking to the Site from any other website without our initial and ongoing consent; or

o    Acting illegally or maliciously against the business interests or reputation of Boekme, our Merchants or our services

4: CONTRACT with BOEKME ADVENTURES

Anyone wanting to make a booking must complete a registration form. By completing the registration and paying the fee you agree to be bound by the Terms and Conditions. You also agree to sign a Liability Release and Assumption of Risks Agreements before trip commencement.The person(s) included on the registration form are referred to as the “client” below. All clients will be bound by this agreement. The terms and conditions set forth below constitute the entire understanding and agreement between you the trip “Participant” and Boekme, its owners, employees, shareholders, affiliated entities, agents, representatives, officers, directors, associates, successors and assigns (collectively, “Boekme,” “we,” “our,” or “us”) with respect to any and all bookings or transactions made with Boekme. The services to be provided are the travel services referred to in Boekme’s website. By submitting a reservation form, you acknowledge that you agree and accept all terms and conditions in this agreement and direct us to perform services on your behalf.

5: PAYMENT and ACCEPTANCE of BOOKING

To make a booking, you must complete our registration form and submit it to us along with payment. Acceptance of your booking must be confirmed in writing (email) by us. There is no contract for services between you and Boekme without such written confirmation.

6: TRIP WITHDRAWALS and REFUNDS

Boekme Adventures provides Amazon jungle adventures as no one else. We pretty much guarantee your satisfaction is you are looking for outdoors adventures at budget pricing. Should you have any reason to withdraw from a trip you registered for, please simply notify us of your intentions. Our policy is as follows: We will refund you 100% of the trip fee if you decide to withdraw 7 weeks prior to the start date of the trip. Cancellations made within 7 weeks prior to the start date of the trip will be credited toward a future trip you can take with us. There will be no refunds if you cancel within 7 weeks prior to the start date of the trip, because of the many initial preparation costs we have incurred. You may cancel your reservation by providing us a written notice via email at info@boekme.com. If you paid for the course online,  we will work with our payment services provider to refund you based on the above conditions. If you paid in cash, we will arrange a suitable time for you to come to the office to claim your refund. We recommend everybody to pay online for the trips since the refund process is way easier for you. Failure to provide us written notification via email of your intention to cancel, prior to the start of the trip will be considered a “no show” and will result in forfeiture of the full amount.

THERE ARE NO EXCEPTIONS to this policy, including for reasons related to weather, terrorism, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this reason, we recommend that you purchase a travel protection plan at the time of booking, as this will cover trip cancellation charges in certain circumstances.

If a client has to be removed from a trip for any reason, you will not be entitled to any refund. We will not reimburse clients for any personal expenses such as airline tickets, other travel or hotel expenses due to changes in itineraries or trip cancellations.

7: CANCELLATION by BOEKME

Boekme reserves the right to cancel a trip for any reason. We will not cancel a trip less than 7 weeks before departure date except in the case of Force Majeure or when the minimum number of participants is not reached. If a tour is cancelled due to the fact that the minimum number of participants is not reached, or in the case of Force Majeure you may choose a full refund of the trip fee, or an alternative trip offered by Boekme. If the alternative tour chosen by you is of lesser or greater value than the tour originally booked then you will be entitled to a refund of the price difference or be required to pay the price difference.

8: MEDICAL FITNESS and AGE

Good physical and mental health is essential for these active, adventure trips. By paying for the trip, you certify that you do not have any physical or other conditions that would create a hazard for yourself or other travelers or affect other people’s enjoyment of the trip. If you are over the age of 70 or have pre-existing medical conditions, you must complete a medical certificate. If you fail to complete and submit the medical certificate 7 weeks before the trip, we reserve the right to treat the booking as a withdrawal by you. Boekme will make the ultimate determination of an individual trip participant’s fitness to embark upon, or to continue a trip. At any time during the tour, including at departure, Boekme  has the right to remove anyone who it judges to be incapable of meeting the rigors and requirements of participating in the tour activities. Once a trip has been confirmed medical circumstances will not be considered as exceptions to our withdrawal and cancellation policy.

9: CHANGES by BOEKME

While Boekme uses reasonable efforts to provide travel services as advertised, reasonable changes in itinerary may be made where considered necessary. Boekme reserves the right to change any of the services and facilities described in the trip descriptions before a booking is made. If such a change is made, we will inform you at the time of booking. If we make a major change after booking, we will advise you as soon as possible if there is time before departure. A major change is defined as a change affecting one full day of the itinerary. If the major change is due to Force Majeure or other circumstances outside of our control no refund or compensation is payable.

10: CHANGES by the CLIENT

If you wish to make a change to your trip itinerary after it has been confirmed, you must submit your request to us in writing by email. You may only make a change to a booking at least 7 weeks before departure. You will be charged any additional costs due to your change.  A transfer from one trip to another can only be made at least 7 weeks before the departure date of the first booked trip. If Boekme accepts such a request, then the company reserves the right to charge an administration fee of 10% of the value of the first booked tour. A request to transfer received less than 7 weeks before departure will not be accepted. In this case the client must withdraw the booking and then rebook on another tour. Such withdrawal and rebooking will be subject to the withdrawal policy set forth above.

11: FLEXIBILITY

The tour itinerary is only an indication of what each group may accomplish and not a contractual obligation. You acknowledge that the nature of this type of travel requires significant flexibility and should allow for changes. You understand that the amenities, type of transport, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems and other unforeseeable factors.

12: RESPONSIBILITIES DURING TOUR

It is your responsibility to be ready at the departure city at the specific tour departure day and time. We are not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Your additional responsibilities include strictly complying with all local laws, respecting customs and culture, assessing your abilities, respecting other trip members’ privacy, and if on a guided trip following the suggestions and advice of the guide. On guided trips, the decision of the local guide is final on all matters that may threaten the safety or interfere with the well-being of the group or individual travelers. During the trip we retain the right to remove anyone whom we deem to be incapable of meeting the rigors and requirements of participating in the trip activities.

13: TRAVEL DOCUMENTS

This agreement, our Release of Liability and Assumption of Risks Agreement, and, if required, medical form must be signed and submitted by all clients before trip departure. If you fail to submit these and other necessary documentation prior to departure, Boekme reserves the right to treat the booking as cancelled by you and impose cancellation fees. Travelers outside of their country of citizenship and residence are required to carry documentation of citizenship , such as a valid passport. It is your responsibility to obtain valid and effective documentation, including passports, visas, permits, and vaccination certificates, where necessary. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. You are also solely responsible for any adverse consequences resulting from missing or defective documentation. While we may provide information or advice on visas, vaccinations, climate, clothing, baggage, special equipment, etc. in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.

14: PHOTO RELEASE

You agree that Boekme may copyright in its own name, use, re-use, and reproduce any images, photos or videos that are taken by our guides and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promotion and publicity purposes worldwide related to our travel products and services.

15: TRAVEL PROTECTION PLAN

The trip price does not include a travel protection plan. We highly recommend that you purchase a comprehensive travel protection plan to cover trip interruption, baggage, accident/life, medical expenses, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you. You agree to assume all costs of medical care and transportation that is provided to you, and any minors traveling with you, during the trip.

16: AIRLINES

Boekme is not responsible for losses due to cancelled flights or seats or changed flight itineraries. You cannot cancel your contract with us without penalty due to a change of airline, aircraft type or destination. Similarly, the contents of our catalog or website do not commit the airlines mentioned there. You further agree that you are subject to all terms and conditions of the airline provider. You are responsible for familiarizing yourself with those terms and agree that you are ultimately responsible to the airline provider for any reservations, changes, cancellations, and disputes regardless of how your reservation was made on your behalf.

17: FORCE MAJEURE

Boekme will not be deemed in breach of these Terms or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this Agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of Boekme including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances. If Boekme is affected by Force Majeure, it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Regarding civil unrest, once Boekme has investigated the prevailing situation, as it deems fit, it shall remain in Boekme’s sole and absolute discretion whether to proceed with the trip.

18: LIMITATION OF REMEDIES

You agree that the sole remedy for any default by Boekme arising under this agreement shall be the refund of the paid trip fee. To the maximum extent permitted under applicable law, Boekme shall not be liable for any special, consequential, indirect, incidental or other damages arising out of this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Boekme has been advised of the possibility of such damages. You expressly waive any right it may have to recover such damages. The foregoing shall not apply to Boekme’s gross negligence or intentional misconduct.

19: SEVERABILITY

In the event that any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision.

20: SUCCESSORS AND ASSIGNS 

This agreement shall inure to the benefit of and be binding upon Boekme and the client and their respective heirs, legal personal representatives, successors and assigns.

21: BINDING ARBITRATION

You agree that any dispute concerning, relating, or referring to this agreement, Boekme’s travel services, Boekme’s tour brochures or any other materials that concern my trip, the tour itself, or any claim for damages due to injury or death which occurs during or in connection with my tour, shall be resolved exclusively by binding arbitration. The binding arbitration shall take place in Paramaribo, Suriname, in accordance with the rules of the Suriname Arbitration Association. Such proceedings will be governed by the laws of Suriname. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforce-ability, conscionability, or formation of this contract, including but not limited to any claim that all or any of this contract is void or voidable.

22: LIABILITY RELEASE AND ASSUMPTION OF RISKS

You voluntarily apply to participate on a trip arranged by Boekme (“we,” “our,” or “us”) with knowledge that travel to foreign countries and/or remote areas visited by this trip involves some risks and dangers. You understand that you are booking an adventure trip to the Amazon jungle and that standards such as accommodations, transport, medical service and other factors will not be maintained or operated to standards common in the the big cities, or on a conventional holiday.

RESPONSIBILITY: As a Suriname-based adventure travel company with representatives in North America and Europe, we organize, promote and sell trips to the exotic Amazon jungle and its many rivers.

ASSUMPTION OF RISK: You acknowledge that you have voluntarily applied to participate in the trip on which you are booked, which will involve outdoor and adventure activities (“Adventure Activities”) and traveling in remote areas. You are voluntarily participating in this tour with the knowledge of the numerous risks involved, which include but are not limited to: physical exertion for which you are not prepared; forces of nature; transportation failures whether by auto, boat, canoe, kayak, by foot, or by any other conveyance; dangers and risks inherent in Adventure Activities; emotional trauma; disfigurement; temporary or permanent disability (including paralysis); death; consumption of alcoholic beverages; risks associated with food or impure water; criminal activity; equipment failures; negligent or willful acts and/or omissions by others; unexpected events; terrorist activities, social or labor unrest; mechanical or construction failures or difficulties; diseases; local laws; acts of God; forces of nature; dangers associated with wild or other animals; breakdown or faulty maintenance of equipment; insufficient instruction or assistance; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; stolen, lost, or misplaced luggage or property; abnormal conditions or developments; or any other actions, omissions, or conditions outside of Boekme Adventures’ control. You understand that Boekme Adventures will have no liability regarding the adequacy of any evacuation plan, medical care, transportation, equipment or supplies that may be provided. Further, you assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination and all safety or security conditions at such destinations. For information concerning possible dangers at an international destination, contact the government office in your country that is responsible for issuing travel advisories.

RELEASE OF LIABILITY: As lawful consideration of, and as part of the payment for, the right to participate in the trip , and as part of the payment for the services arranged for you  by Boekme Adventures, YOU HEREBY EXPRESSLY AGREE TO BE RESPONSIBLE FOR YOUR OWN WELFARE AND ALL MINORS TRAVELING WITH YOU AND ASSUME ALL OF THE ABOVE RISKS, INCLUDING BOTH THOSE KNOWN AND UNKNOWN TO YOU. As lawful consideration of, and as part of the payment for, the right to participate in the tour, and as part of the payment for the services arranged for you by Boekme Adventures, YOU HEREBY EXPRESSLY AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS FOREVER Boekme Adventures, its owners, employees, shareholders, affiliated entities, employees, agents, representatives, officers, directors, associates, volunteers, successors and assigns from and against any liability, actions, causes of actions, debts, suits, claims and demands of any and every kind and nature whatsoever which you now have or which may hereafter arise out of or in connection with your tour or participation in the activities arranged for you by Boekme Adventures.

YOU AGREE THAT THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for yourself, all members of your family and all minors traveling with you, you and their heirs, successors, assigns, and legal representatives; it being your intention to fully assume all risks associated with this trip and to release Boekme Adventures. from any and all liability to the maximum extent permitted by law.

COVENANT: You hereby agree not to sue Boekme Adventures, its owners, employees, shareholders, affiliated entities, agents, representatives, officers, directors, associates, volunteers, successors and assigns for any liability, actions, causes of actions, debts, suits, claims and demands of any and every kind and nature whatsoever which you now have or which may hereafter arise out of or in connection with my tour or participation in the activities arranged for you by Boekme Adventures.

LIMITATION OF REMEDIES: You agree that to the extent consistent with applicable law, the maximum amount of recovery to which you may be permitted to recover from Boekme Adventures shall not exceed the amount of the paid tour cost less actual expenses incurred by Boekme Adventures in arranging for your travel services. To the maximum extent permitted under applicable law, Boekme Adventures shall not be liable for any special, consequential, indirect, incidental or other damages, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Boekme Adventures has been advised of the possibility of such damages. You expressly waive any right it may have to recover such damages. If you, or any of your heirs, or anyone acting on their own in your behalf should bring such suit, you shall pay all attorney fees, related court fees and defense costs should you not prevail. This paragraph shall not apply to Boekme Adventures’ gross negligence or intentional misconduct.

BINDING ARBITRATION: You agree that any dispute concerning, relating, or referring to this agreement, Boekme Adventures’ travel services, Boekme Adventures’ trip brochures and catalogues, or any other materials that concern your trip, or the trip itself, shall be resolved exclusively by binding arbitration. The binding arbitration shall take place in Paramaribo, Suriname, in accordance with the rules of the Suriname Arbitration Association. Such proceedings will be governed by substantive (but not procedural) Suriname’s law. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any of this contract is void or voidable.

KNOWING AND VOLUNTARY EXECUTION: You have carefully read and understand the provisions and legal consequences of this agreement and Boekme Adventures’ Terms and Conditions, and you hereby agree to all of the terms and conditions contained in both agreements. You agree that this release and waiver is intended to be as broad and inclusive as permitted by the laws of Suriname and if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

You acknowledge that in calculating the cost of the tour, Boekme Adventures has relied on your consent to these terms and their enforceability. In the absence of this agreement, the tour cost would have been higher or, alternatively, Boekme Adventures would be unable to offer these services.

You certify that you have read and understand above provisions and bought the trip with full knowledge of the above.  You understand this is a legally binding and enforceable contract.

23: MERGER

This agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements. You certify that you have read and voluntarily agree to these Terms and Conditions, prior to booking a trip.
